Terms & Conditions

Last updated · 21 October 2026

These terms govern your use of digiturbine.in and set the commercial and legal frame for engaging Digiturbine. They are written to be read once, understood fully, and rarely needed again — which is exactly how we like contracts to behave.

01Acceptance of Terms

By accessing or using digiturbine.in (the “Site”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree with any part of them, please do not use the Site. These Terms apply to the Site itself — visitor browsing, form submissions, and informational downloads.

Services delivered to clients are governed by the individual statements of work, engagement letters, or master services agreements signed with each client. Where a signed agreement and these Terms conflict regarding an active engagement, the signed agreement prevails.

02About the Site & Our Services

The Site presents Digiturbine’s practice areas: desktop advertising, mobile performance campaigns, performance marketing, native placements, programmatic RTB, and interstitial advertising. Content on the Site — including case metrics, benchmarks, and methodology descriptions — is provided for informational purposes and reflects past or typical engagements.

Nothing on the Site constitutes an offer, a guarantee of campaign outcomes, or professional advice for your specific situation. Growth outcomes depend on factors that include your product, market, creative assets, data quality, and platform dynamics beyond anyone’s control.

03Engagements, Proposals & Fees

Work begins only after both parties sign a proposal or statement of work that defines scope, deliverables, timelines, success metrics, and fees. Unless stated otherwise in a signed document: fees are quoted exclusive of applicable taxes, including GST; media budgets are billed at cost and pass through without markup unless explicitly agreed; and invoices are payable within the stated credit window.

Late payments may pause active campaigns, and we will communicate any such pause before it happens. Estimates for media performance shared during pre-engagement discussions are directional planning figures, not commitments.

04Client Responsibilities

Effective performance marketing is a two-way operation. Clients agree to provide timely access to the accounts, analytics, store consoles, and creative source material needed to do the work — and to grant approvals within agreed windows so campaign calendars hold.

Clients also affirm that the apps, products, and claims they promote comply with applicable laws and the policies of the relevant ad networks, app stores, and data-protection frameworks. We may decline or pause work on material that we reasonably believe violates platform policies or law.

05Third-Party Platforms

Our work depends on advertising networks, app stores, measurement partners, and other platforms operated by third parties. Their pricing, inventory, algorithms, and policies can change at any time and are outside our control. Where a platform changes the rules mid-flight, we will re-plan and inform you promptly — but we cannot guarantee uninterrupted placements, specific inventory, or platform behavior.

Your use of any third-party platform remains subject to that platform’s own terms, and our engagement does not make us a party to your relationship with them.

06Intellectual Property

The Site — its text, design, logos, and brand marks — is the property of Digiturbine and is protected by applicable intellectual-property law. You may reference or quote it with attribution, but you may not republish it wholesale or use our brand to imply a relationship that does not exist.

For engagements: creative concepts, campaign structures, and frameworks developed specifically for a client are licensed to that client upon full payment for the applicable work. Our pre-existing tools, methodologies, playbooks, and generic know-how remain ours — you get the benefit of using them, not exclusivity over them.

07Confidentiality

Campaign data, unit economics, creative assets, and strategy shared between Digiturbine and a client are confidential to that relationship. We protect them with the same care we apply to our own and only share them internally with team members who need them to deliver the work.

Anonymous, aggregated learnings — such as category benchmarks that cannot be traced to any client — may inform our public writing and methodology. This is standard practice in performance marketing and is what keeps our playbooks sharp.

08Warranties & Performance

We commit to performing services with the skill, care, and diligence of a professional performance marketing practice, applying the methods and benchmarks described in each signed statement of work. That is the warranty we give — and it is an honest one.

We do not warrant specific future metrics such as install volumes, CAC, ROAS, retention, or eCPM levels. Markets shift, platforms change, competitors act. Anyone who “guarantees” performance outcomes in this industry is selling certainty that does not exist.

09Limitation of Liability

To the maximum extent permitted by law, Digiturbine’s aggregate liability arising out of or related to the Site or any engagement is limited to the fees actually paid by the client to Digiturbine in the three months preceding the event giving rise to the claim.

Neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or missed campaign opportunities — except where such exclusion is not permitted by applicable law, or where liability arises from willful misconduct or fraud.

10Term & Termination

You may stop using the Site at any time. Engagements end according to the notice periods in their signed documents; on termination, we deliver completed work products, return client-owned assets, and wind down active campaigns responsibly so media in flight is not left unattended.

11Governing Law & Disputes

These Terms and any disputes arising from them are governed by the laws of India. Courts at Delhi have exclusive jurisdiction, without prejudice to either party’s right to seek urgent interim relief where genuinely required.

We prefer conversation over litigation. If something is not working, tell us first — most disputes in this industry are expectations that were never verbalized, and we would rather fix the expectation than fight about it.

12Changes to These Terms

We may update these Terms from time to time. The “last updated” date above reflects the current version, and material changes will be noted on this page. Continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
